    What a merchant must do

    Nebraska permits any person selling goods or services in a cash transaction, making any cash payment or transfer, or paying cash wages to round to the nearest five cents: final digits 1, 2, 6 and 7 round down, 3, 4, 8 and 9 round up, and a total of one or two cents rounds up to five cents. A person must choose one method per premise, either rounding the total cash transaction amount including taxes and fees or rounding the final cash amount paid out or returned, and may not use both.

    Tax base treatment

    Tax base is pre-rounded. Sales price, taxes, and government-imposed fees must be calculated and imposed in the exact amount without rounding, and all taxes are remitted on the sales price prior to rounding. The act characterizes rounding as an administrative settlement of the physical payment, not a release or commutation of any tax under Article VIII, section 4 of the state constitution.

    Mixed tender treatment

    Non-cash payment is applied first to the amount due, with any remaining balance payable in cash. Rounding applies solely to the final settled cash amount paid by, paid out to, or returned to a customer or employee.

    Liability protection

    Express statutory safe harbor. A person selling goods or services is not in violation of any state or local requirement, law, regulation, or standard based on any action taken in compliance with the rounding section.
